NSW:NSW driver killed as coal truck rolls

A coal truck driver's been killed when his vehicle rolled down a two-metre embankment
in Newcastle.

The 62-year-old man was driving along John Renshaw Drive, en route to Port Waratah,
shortly before eight this morning when his semi-trailer jack knifed at Beresfield, about
600 metres west of the F3 and Weakelys Driver intersection.

It then rolled over a two-metre embankment, coming to rest upside down.

The cabin of the semi was partially crushed and the driver died at the scene.

A report will be prepared for the coroner.

IDC: Smart Systems Microprocessor Cores to Double to Over 12 Billion by 2015
Type: News

The International Data Corporation (IDC) announced that its semiconductor research team published a preliminary report saying that smart systems - those with programmable processor cores, high- level operating systems (OSes), and IP-capable connectivity - will consume more than 12.5 billion processor cores representing more than $100 billion in revenue by 2015, more than double the number of cores that shipped in 2010.

Moreover, that number is set to nearly double again by 2020 to an estimated 24.6 billion cores. IDC will issue the findings at the SMART TECHnology World conference, April 19-20, in San Francisco.
IDC's Mario Morales, program VP, Semiconductor and EMS Research, will detail the report's major findings in his keynote presentation, "Smart Tech Market Forecast and 2020 Vision," which kicks off the conference. For the first time, the IDC report and the SMART TECHnology Conference seek to give meaning to the "smart" market by defining its taxonomy and quantifying its size and value.

The IDC report will be the first in a series of quantitative studies that size and forecast the adoption of technologies, including programmable microprocessors, systems on a chip (SoCs), high-level embedded OSes, and pervasive connectivity technologies that embed intelligence into formerly dumbed-down and disconnected embedded systems.

The Smart Technology World Conference is the beginning for companies that are now coming together to define the future of the smart system market opportunity. Join our speakers and market leaders as they provide their perspectives on how the market will evolve and what new devices, technologies, and business models will take hold.

"The Embedded Internet is creating a design paradigm loaded with new opportunities and new responsibilities," said Ton Steenman, VP, Intel Architecture Group and General Manager, Embedded and Communications Group. "This event brings together key thought leaders from across the ecosystem to address these challenges; creating a living lab of innovation for the future of the embedded industry."

"Today we have the tremendous opportunity to transform how embedded technology is understood and utilized as part of a modern enterprise IT strategy by moving beyond traditional, standalone devices," said Kevin Dallas, general manager of the Windows Embedded business at Microsoft. "I look forward to joining other industry leaders to discuss this fundamental shift and presenting an exciting vision for how harnessing the cloud can revolutionize the way embedded devices are built, how we use them, and the value they provide across our work and personal lives."

NSW: Stranded Jetstar passengers swear off airline

SYDNEY, April 15 AAP - Jetstar passengers stranded in Honolulu for two days after their
plane broke down have sworn they will never fly with the budget airline again.

About 300 Australians were left at Honolulu airport for two days after Jetstar botched
attempts to get them home.

Two aircraft flew the tired and frustrated passengers back to Melbourne and Sydney
today, with some travelling for three days to get home.

The trouble for around 100 passengers began on Friday morning when their Jetstar flight
was cancelled after an electronics problem prevented the plane leaving Australia to pick
them up in Honolulu.

The passengers were moved to a Saturday morning flight but the problems worsened when
the Airbus A330 scheduled to take them - and another 200 passengers - was grounded.

Jetstar spokesman Simon Westaway said the plane was inoperable because of a fault detected
in its fuel gauge.

"It's an unusual fault and required a number of tests on the indicator inside the left
wing where a large section of fuel is held," Mr Westaway said.

"It required the wing to be drained of fuel."

He said passengers were kept informed of the problems, were looked after at Honolulu
airport and given overnight accommodation.

But angry passengers at Melbourne airport had nothing but criticism for the airline's
customer service.

Father-of-three Braham Shnider has sworn off the airline after the ordeal.

"I certainly wouldn't fly with them again," he told the Seven Network.

"I would say there would not be a single soul on the aeroplane that would fly with them again."

Other passengers, who did not gave their names, echoed his sentiments.

"I'm very tired, and Jetstar is very terrible at customer service," one woman said.

"Everybody had something different to say, nobody knew what was going on."

"I will never fly jetstar again, ever," another woman said.

Mr Westaway denied passengers had been left in the dark.

"The airline rejects accusations that we haven't sought to get the problem rectified
as quickly as possible," he said.

"We used other airlines to move customers and people have got to understand that there
are not myriads of services between Honolulu and Australia each and every day.

"We think we have done a pretty good job in difficult circumstances," he told the Nine Network.

"We think people will continue to fly with us."

What Australian papers say on Thursday, December 13, 2006

AAP General News (Australia)
12-14-2006
What Australian papers say on Thursday, December 13, 2006

SYDNEY, December 14 AAP - The takeover offer for Qantas has prompted a Sydney Morning
Herald editorial headlined "Private Equity and Public Pain.

"Here's the deal," says the Herald.

"Loans are cheap, so you borrow money to buy out a company's public shareholders.

"You cut costs, boost revenue, then sell the revamped business back to the public.

"As well as the profit, there are huge fees all along the way. In just a few short
years you've made a motza.

"What could go wrong?"

Well, lots, actually, cautions the Herald.

"Interest rates could go up and the economy turn down; your 'private equity' deal could
become a very public disaster."

No wonder, says the paper, the governor of the Reserve Bank, Glenn Stevens, is sounding
the alarm.

"Australia's top banker has joined the chorus of concern about the boom in private
equity takeovers," says the Herald.

"It has seen a string of multi-billion-dollar transactions, of which the spurned $11
billion takeover bid for Qantas would have been the biggest.

The Herald says the term "private equity" is misleading as it suggests shareholders
putting capital into business.

"But these deals are all about replacing share capital with borrowings."

That may work well when times are good, says the paper, but as Mr Stevens has cautioned,
Australia will inevitably face "less forgiving circumstances than ... over the past decade."

The Australian headlines its main editorial "Qantas and the fear of a crash landing".

The paper says it is an uncomfortable irony that the Qantas board has rejected an $11
billion debt-funded takeover offer just as the world's central bankers united to warn
of a possible crash landing.

"Qantas directors are duty bound to make sure they extract every cent they can for
shareholders from any corporate raider who comes knocking," says The Australian.

And their rejection has forced the suitor to lift their offer and drop a condition
that a $100 million break-fee be paid to merchant bankers should the deal fall over.

"That's the free market, says the paper.

"Qantas is a private company, and the deal is small beer in the context of the debt
bubble that has prompted warnings from the financial market regulators.

And it says Reserve Bank governor Stevens is the latest to add his voice to the chorus
of concern that heavy corporate borrowings to fund deals such as the Qantas bid may result
in a painful landing should the world economy experience a shock.

The Australian adds that the Qantas deal is just the latest in a line of multi-billion-dollar
bids that are transferring ownership of publicly listed companies into private equity
syndicates.

"These syndicates are soaking up the world's retirement savings, and need the target
companies to generate big profits to pay the interest bill."

Meanwhile, under the headline "Changed climate helps trade talks", the Australian Financial
Review says the mere suggestion that a comprehensive
free-trade deal with Japan - covering agriculture as well as services, resources and manufactures
- could be achievable would have been dismissed with hearty guffaws only a few years ago.

But now that FTA talks with our largest trading partner and the world's second largest
economy are finally being launched, the prospect doesn't seem quite so far-fetched.

The Fin Review says profound changes in Japanese society and politics, as well as in
the regional balance of economic and strategic power, are forcing the hand of that country's
political class

"Things once unthinkable are now not only being thought but being done," the paper says.

"Japanese agriculture - among the one or two most lavishly protected farm sectors in
the world - may not be the obstacle to trade reform it once was."

An editorial in Brisbane's Courier Mail says the Anglican Church is to be commended
for its efforts to introduce tough new psychological profiling to weed out potential paedophiles
among trainee and existing clergy and eventually, among all church workers.

The paper says that while such offenders are only a small minority, their evil, criminal
acts have caused their victims devastating, long-term suffering and cast a serious slur
over mainstream churches in recent years.

"As they draw on the expertise of psychologists, the churches must also pay close attention
to the faith lives of those they prepare for ministry, because child sex abuse represents
the ultimate breakdown or betrayal of Christian faith," the Courier Mail concludes.

A Melbourne Herald Sun editorial says the Bracks government's determination to reform
the legislative council has come back to bite it.

The newspaper says Victoria is faced with the same frustrating uncertainty "born of
minority agendas" that once afflicted the senate.

It comes after two Democratic Labor Party candidates appear to have won two legislative
council seats in the recent state election.

The newspaper says they will be the unlikely partners sharing the balance of power
with the Greens and the Nationals.

"It seems too much to hope the minority MLCs will acknowledge the mandate Victorians
gave the Bracks Government," the editorial says.

"But if they overplay their grip on power and parliament becomes gridlocked, Victoria
will suffer."

The Melbourne Age says the Bracks Government only has itself to blame for the resurrection
of the Democratic Labor Party.

The DLP has not held a seat in a Victorian parliament since 1958 but in the recent
state election won two seats in the reformed upper house.

The newspaper says although the government has won a recount, "nothing will compensate
for the shock factor that has seen the DLP back on its feet", potentially sharing the
balance of power with the Greens and Nationals.

But the newspaper blames the government for its own misfortune by trying "but ultimately
failing" to manipulate the complexities of the reforms to its own political advantage.

"Labor, by favouring the DLP against the Greens, which it expected would grab the balance
of power, unwittingly ... brought the DLP back from the dead and left the government short
of control of the legislative council," the editorial says.

"Any electoral system that allows for any party with a minimal number of votes to come
first, needs careful scrutiny: elections must be determined by the people who vote, not
those who meet in darkened party rooms."

Finally, the Sydney Daily Telegraph says the New South Wales Police officers and "spin
doctors" who have tried this week to argue that a locked police station bearing a sign
overnight saying it was closed for business was actually open and operating normally,
should be given an award - for unparalleled effrontery.

Fed: Janelle Patton's parents arrive on Norfolk for court date

NORFOLK ISLAND, Aug 7 AAP - Ron and Carol Patton have arrived at the Norfolk Island
court house ahead of today's committal hearing for the man charged with murdering their
daughter, Janelle.

The Sydney couple arrived on the island early this morning and said they hoped to learn
as much as possible about what happened on March 31, 2002, the day their daughter died.

New Zealander Glenn McNeill, who had been working as a chef on Norfolk Island, was
arrested in February and charged with her murder.

Outside the court, Carol Patton said: "We expect that it will be a very difficult week for us.

"We have mixed emotions coming back here to Norfolk Island as there has been some very
happy times for us here and it was our daughter's home for nearly three years.

"However, it was also where our daughter Janelle died."

Ms Patton, 29, disappeared while taking a walk on one of the island's roads.

About six hours later, her body was found at an island reserve with more than 60 separate
injuries.

McNeill's committal hearing is expected to last five days.

"We are here mainly to represent Janelle in this legal process and to get as many answers
as possible about what happened on Easter Sunday 2002," Mrs Patton said.

Women Finding Camaraderie in Biker Clubs

KELLI KENNEDY, Associated Press Writer

The Motorcycle Industry Council said 467,400 women owned their own bikes in 1998, compared to 635,000 in 2003. (AP Photo/John Raoux)

When Roe Hyer was diagnosed with breast cancer so advanced that doctors gave her only a month to live, the single mom decided to finally start living.

The spunky hairdresser, then 39, was tired of "being a passenger" in life. She moved to Florida, took up body building and bought her own motorcycle _ a metallic blue Suzuki Intruder 800.

Hyer is one of thousands of women across the country finding camaraderie in women's motorcycle clubs. From the Chrome Divas in Columbia, S.C., and the Women on Wheels in Lincoln, Neb., to the Throttle Queens in Landover, Md. and the Motor Maids in Erie, Mich., women are increasingly taking to the open roads.

"I didn't have control of the cancer, there's nothing you can do, so riding is something you have control of," said Hyer, now 54.

Women bikers aren't your stereotypical bar-brawling, tattooed, leather jacket biker chicks. The new wave of female riders are soccer moms, even grandmas, corporate attorneys and nurses with an average income of $55,850, according to the Motorcycle Industry Council.

The number of women who own their own bikes is on the rise _ jumping 36 percent to 635,000 between 1998 to 2003, according to the most recent numbers from the Motorcycle Industry Council, a trade group based in Irvine, Calif.

Manufacturers such as Harley-Davidson and Ultra Motorcycles are capitalizing on the trend, designing bikes with lighter frames, custom fit gears and lower seats.

"It's pretty much been a men's market, but a lot of ladies really like riding motorcycles and I think they feel left out so that's why we created something just for women," Ultra Motorcycles sales director Dan Houston said of his company's Groundpounder and California Kid models.

At Harley-Davidson, motorcycles sales to women are at an all-time high, jumping from 600 in 1980 to 30,000 in 2005. Women make up about half of new-rider classes on the test track at Harley-Davidson Orlando, said Tony Cianciotto, marketing manager at Harley Orlando.

"I think for so long women have ridden on the back, but nowadays women are very independent," Cianciotto said.

The winding roads offer women an escape from crying babies, stressful jobs and high-maintenance relationships. When Army nurse Edna Valesquez returned from Iraq in 2003, riding helped to melt away horrific memories of wounded troops. Despite her petite 5-foot frame, Valesquez, nicknamed Lil' Bit, rides a 640-pound Harley Low Rider.

"It's a little escape. You can get on those back roads and you just go," said Valesquez, who started the Chrome Divas in August 2005.

Many female riders plan this week to roll up to Daytona Beach's annual Bike Week, which started Friday, to gab with the thousands of fellow bikers from around the country who gather to scope out the merchandise and ride the test tracks.

"We're definitely seeing a trend in more female riders" showing up at Bike Week, said Kevin Kilian, official for Daytona's chamber of commerce.

But there is still a struggle against stereotypes. At Bike Week, some female riders complain that one of the only events specifically involving women is a coleslaw wrestling contest _ which female riders say only serves to perpetuate misconceptions about them. Some, like Janet Barrett of Clermont, won't attend.

"I'm just a 50-year-old Harley riding grandma," said Barrett. "I've gotten very discouraged by the quality of riders that attend Bike Week. I ride to ride."

For many of the women's motorcycle clubs, charity is a central purpose. More than 200 female clubs are listed on the Internet, with groups catering to older riders, Christian riders and black riders. A majority include charity work in their charter.

The Chrome Angels of Central Florida dedicate their fundraising efforts to breast cancer causes, said Jessi Sills, who founded the group after her mother died of breast cancer.

The Sarasota-based Diva Angels, started by Marsha Wolak, has spawned seven chapters with about 150 members, and it has raised funds for dozens of charities, including the National Children's Drug Awareness program, the American Legion, Toys for Tots and Big Brothers/Big Sisters.

"We're here to ride and have fun but we also want to help people less fortunate than ourselves. We wouldn't do one without the other," said Wolak.

A total of 556 .de sites were defaced in 2001 but the figure for 2002 is already much higher at 995, with 263 of these taking place so far in May, according to the mi2g Intelligence Unit.

Sites defaced include hotels, retail businesses, universities and Internet Service Providers.

The majority of the attacks are due to a single hacker group that became active on 23rd March 2002. Since then, it has been responsible for 64% (484/752) of .de defacements, 72% (108/150) of .at defacements and 54% (85/158) of .ch defacements, with the rest being carried out by various smaller groups and individuals.

Of the German systems defaced in 2002, 75% are running on Linux. These Linux based sites deploy open source third party portal and forum applications. The hacker group responsible for the recent attacks on German websites is exclusively targeting Linux based sites, exploiting some of the known open source application vulnerabilities.

"So far, the security balance appeared to be tilting against proprietary applications but the recent wave of German attacks has shown that vulnerabilities within open source applications can be just as easily exploited," said DK Matai, Chairman and CEO, mi2g. "There is no substitute for configuration management, which includes downloading the latest patches in a world of 24/7 connectivity."

According to the mi2g Intelligence Unit, the updated figure of .com defacements worldwide in 2001 was 9,022, while in 2002 the number so far is 3,559. The overall figure for web site defacements in 2001 was 31,291 while in 2002 the number so far is 12,116.

An interesting feature of the recent attacks on the .de domain is that some waves have been associated with single IP addresses, indicating that some of the targeted groups of sites have been running on the same machine. Growth in the deployment of virtual hosting systems, where a single machine hosts many websites, is fast becoming a substantial source of digital risk.

ECONOMIC POLICY: DRAFT SUMMARY REPORTS FROM COMMISSION TO EU SUMMIT.(Brief Article)

The Commission regards 2000 as a good year for the European economy. Almost 2.5 million new jobs were created with more than two-thirds of these posts being filled by women. However, in spite of robust growth and healthy public finances, the text warns that the EU cannot afford to rest on its laurels. The current good economic climate must be used to good effect to accelerate rather than slow down the implementation of difficult reforms.Evaluation.In evaluating the progress made since the Lisbon European Council, the Communication highlights the following fields:- opening to competition of local telecommunications through the unbundling of local loops since 1 January. This measure should contribute to reducing the cost of Internet access;- adoption of the European company statute after more than thirty years of negotiation;- political agreement on the fiscal package;- implementation of the first phase of rail liberalisation with the adoption of standards for the total opening to competition of freight transport from 2008;- adoption of an action plan for combating discrimination. However, the Communication also identifies certain delays in the adoption of measures announced:- discussions are still on-going on further deregulation of postal services;- disappointing progress in the adoption of new rules for public procurement and European brands;- the implementation of liberalisation in the gas and electricity sectors has still to be applied in a uniform fashion across the European Union;- in spite of progress in the opening to competition of the international transport of goods by rail, the challenges posed by domestic passenger and freight transport have yet to be tackled;- insufficient progress in the implementation of the lifelong learning strategy, notably through the setting of national targets.Training and mobility. In addition to setting intermediate targets, Romano Prodi also urges Member States to put in place national objectives, notably to increase the number of persons in the 55-64 age group who remain on the labour market. In 1999, only 37% of this population band was still active on the employment market. Member States should include these objectives in their national employment action plans. The European Commission proposes to establish a high-level Working Party on mobility and high-level qualifications. This group will present a report to the Council before Spring 2002. By June of this year, the Member States should adopt the recommendation on the mobility of students, persons undergoing training, voluntary workers, teachers and trainers. The Council should concurrently adopt proposals to modernise existing regulations on social security arrangements for migrant workers. The Commission pledges to present an action plan to the Council before spring 2002 to promote the development and opening of new European labour markets by 2005. Proposals will also be tabled next year concerning a more uniform, transparent and flexible system for the automatic mutual recognition of professions. The elimination of transboundary fiscal obstacles which currently prevent the "portability" of supplementary pensions is also on the agenda.Wider liberalisation.Regarding the services sector, which already generates 75% of EU GDP, the Member States should accept the full liberalisation of gas and electricity markets for business users in 2003 and 2004 respectively, and for private consumers in 2005. The implementation of the European single sky by 2004 should also be accepted. The European Commission pledges to bring forward concrete proposals in June to review the slot allocation system at Community airports, along with a second raft of measures to open up domestic rail-freight and passenger transport markets. In March, the Council will table necessary measures for the deregulation of the transport and energy sectors, along with framework provisions guaranteeing the effective development of transboundary energy markets. In the context of the development of the eEurope initiative, the Council and Parliament should pledge to adopt in June the proposal on copyright in the information society and, before the end of the year, provisions permitting the levying of VAT on electronic commerce activities. Measures concerning the introduction of a .eu top-level Internet domain name should available for the Laeken European Council in December.Social inclusion. Finally, among a raft of measures in the social field, Romano Prodi calls on the Council and Parliament to agree to the adoption of an action programme on social inclusion. Member States should redouble their efforts to combat social exclusion and agree before the end of the year to indicators in this area.

Cube8.com Plc acquires 14% of Dynamid Limited with options to increase stake to 25%.

M2 PRESSWIRE-15 May 2000-Cube8.com: Cube8.com Plc acquires 14% of Dynamid Limited with options to increase stake to 25% (C)1994-2000 M2 COMMUNICATIONS LTD

RDATE:15052000

Cube8.com (www.cube8.com), the AIM-quoted internet incubation and investment company which also provides strategic management consulting and technology services, is pleased to announce that it has acquired a 14% stake in Dynamid Limited. Cube8.com also has options to increase its stake in Dynamid to 25% within 12 months. Dynamid is in talks with several substantial logistics and retailing companies with regard to alliances and a further substantial round of funding.

Via a network of 'intelligent' delivery boxes, London-based Dynamid (www.dynamid.com) will offer a unique solution to allow unattended receipt and despatch of goods for both businesses and consumers. The storage boxes will allow deliveries or collections to be made 24-hours a day, with access via a patent pending secure code generation system. Users will be notified of deliveries and collections via email and mobile messaging.

The technology promises to greatly enhance existing fulfilment systems, which to date have failed to solve the problems with the final stage of the delivery process. The technology will reduce the number of wasted journeys by delivery vans, and also allow delivery companies more flexibility in arranging their routes and schedules. Domestic consumers have typically tended to prefer the same early evening delivery slots for groceries and other items - the Dynamid technology will also help solve this problem.

Dynamid plans a London trial of a complete range of delivery solutions designed to sit outside homes, in the workplace or at public-access locations such as railway stations. Dynamid is expecting to start commercial installations within 3-6 months and expand the business across Europe and beyond during 2000-2001.

This investment fits into the enabling technology part of the Cube8.com portfolio, and also has a bricks and mortar element with the physical installation of the Dynamid delivery systems.

Commenting on the investment, Tim Dean-Smith, Chairman and Chief Executive of Cube8.com said, "The Internet has transformed how people purchase goods making it quick and simple to order on-line. The problem is that you've still got to wait at home for delivery. Dynamid's technology will make the delivery as easy as the order, and that's good news for consumers, e-commerce companies, and the companies making the deliveries. There is a huge market for this technology." Dan Turner, CEO of Dynamid, said, "We chose Cube8.com as a strategic investor due to their expertise and contacts in the ecommerce arena. Access to this invaluable resource will provide us with a competitive edge as we roll the business out across Europe." John Winfield, Finance Director of Cube8.com will join the board of Dynamid as Finance Director with immediate effect.

Note to editors: Cube8.com plc is a technology focused incubator and investment company, principally established to identify, invest in, and grow start-up businesses within the internet, media and technology sectors.

Cube8.com provides marketing, sales channels and contacts for US based business looking to expand into Europe and also for European businesses looking to expand to other parts of the world. The company's shares started trading on the Alternative Investment Market (AIM) of the London Stock Exchange on 28th February 2000.

Dynamid was formed in 1999 as a provider of commercial solutions to improve the reliability of business-to-business and business-to-consumer delivery services. The company is focussed upon network-based systems that can be used to ensure the security of unattended receipt and despatch of goods.

What's In A Tasty Name: Casey's Cupcakes[TM] Intellectual Property Rights Are Too Good To Eat.

So almost everyone in Laguna Beach has now heard about the grand opening of Casey's Cupcakes on Ocean Avenue, right? I was fortunate enough to be there, on Valentine's Day when they opened, buying a scrumptious cupcake for my primary, if somewhat reluctant, valentine that day, my twelve -year old son Sean, who is certainly very discerning when it comes to sugar products.

Not only did my valentine's gift strike a sweet chord with Sean, but it was a memorable event, which I will always associate with tasty and extremely attractive cupcakes, good music, bold pink in a quaint, bright setting, and, of course, a yummy view of Casey herself and her many stunning cupcake assistants. But it also set my mind to meandering about the intellectual property (IP) rights of cupcake entrepreneurs like Casey. You know, patents, trademarks, copyrights, false advertising, unfair competition, that sort of thing. And mind you, this was weeks before the well-promoted and televised Cupcake Wars episode on The Food Channel in which Casey, whose cupcakes are not be truffled with, trounced the other cupcake contenders.

What is my basis for examining Casey's cupcakes in more fragrant and edible legal detail? Do I have a well-honed culinary nose or tongue or gourmet palate? Well, maybe, maybe not, but I prefer to go on my experience handling intellectual property legal issues for such food and beverage clients as See's Candies, Vivoli's (gelato), Bon Appetit, The Gourmet Retailer, Margaret Fox's Cafe Beaujolais, Martinelli's, Coke-Cola, Hansen's, to name a few. And I went through the "Cookie Wars" in a case involving the look and feel of one company's allegedly exclusive line of cookies in such shapes as Christmas trees and hearts. But I don't recall an IP case involving a food product so delicious and mouth-watering as Casey's Cupcakes. And, though I am not their attorney, I have eaten Casey's Cupcakes many times now, as have both Sean and his 8 year-old brother Troy.

Can Casey protect her cupcakes? And how? No matter how one slices it, the answer is succulent and aromatic. But before discussing her rights (and, by the way, with no permission or endorsement of any type from Casey's Cupcakes, these are solely my opinions), I'd like to share with you the legal Westlaw "Head Note" of March 8, 2011 from Thompson Reuters West, also the publisher of my own IP book, Trade Dress Protection."

"While prisoners have a right to sufficient food to provide adequate nutrition, there is no requirement that the food be tasty or even appetizing. In re Doe, 793 N.W. 2d 209 (Wis. Ct. App. 2010)"

Based on this recent head note, one new morsel of food news is apparently that prisoners are not entitled to have Casey's Cupcakes" for dessert. In view of all the recent news about several murders in Laguna Beach, I urge all of my readers to suppress any homicidal tendencies if you value your high-end cupcakes. This alone should be a sufficient deterrent to a life of crime, paying the ultimate price, no food that is even appetizing - and I thought that was constitutional right of some kind. As my kids remind me whenever I try to prepare a gourmet meal for them.

First, the name Casey's Cupcakes", is generally protectable under federal and California trademark and trade name law, and related unfair competition law under federal and California statutes. If no one else used something confusingly similar first, and the name meets other trademark requirements, for example, that it is not "merely descriptive." And there are some limits on stopping another person in the cupcake industry whose name is also Casey from using a similar name, though it has been, such as with the Gallo name for cheese. But it should not be as mundane as something like "Bob's Burgers." Trademark protection might extend to some of the names used by Casey for her individual cupcakes, though probably not if they are in use by various third parties, such as Red Velvet, or have become generic for a particular flavor or composition or taste. Names like "Chocolate Fudge" have been litigated, with varying success.

Second, the actual recipes for Casey's individual cupcakes may be protected, particularly a collection of them, but that will not necessarily stop someone who has access to them from making them using the recipe. However, that person cannot copy the text of the recipe. In addition, though not particularly common or easy, many food recipes have been protected under the United States patent laws, which is much stronger protection if available. If it would be hard for someone to "reverse engineer" the taste and ingredients for her cupcakes, Casey might keep the recipe protected indefinitely as a "trade secret," like the formula for Coke-Cola[R] has been for a long time, although recently it may have lost that status due to a disclosure of the full formula on the Internet albeit not by its manufacturer.

Third, the "look and feel" of Casey's distinctive cupcakes, that is, t heir "product design" or "packaging" may be protected, in certain instances, under "trade dress" law. The same is true for her unusual and distinctive looking store, as combinations of distinctive features for retail stores, restaurants, bars, and other businesses, have been protected when they meet the relevant standards. Not all do, but many have. Trade dress may be very potent protection for Casey, including such features as her color combinations. Trade dress may be registered in the United States Patent and Trademark Office as a special type of trademark.

Last, but not least, if Casey's competitors do such smelly and unflavorful things as copy her web site, marketing brochures, photographs of her cupcakes, or falsely compare her exquisite cupcakes to their own trite or stale products, she may be protected by copyright, unfair competition, and false advertising laws. And we won't even discuss now what happens if some Philistine doesn't like Casey's cupcakes and starts a "CaseysCupcakesSucks.com" or "CaseysCupcakesGoingDown.com" or similar pejorative web site, because her cupcakes are simply too good. Well, time to go get some dessert.

Video Fix: Tom DeLay does the cha cha.(The Big Blog)

Hello. Today Video Fix has the following -- Tom DeLay doing the cha cha and his colleagues' reactions, Will Ferrell doing a sarcastic PSA defending health insurers, a full vid of Obama on Letterman and Glenn Beck's interview with Katie Couric.

Must see TV

This is real, ppl: Look! Look at Tom DeLay dance!

It happened last night on "Dancing with the Stars." I think the close-up of DeLay shaking his fanny is kind of unnecessary. I can see him shake it from a comfortable distance, too.

Still, it wasn't half bad. Any wagers on how far he'll go in the competition?

A CBS reporter then showed the dance to a bunch of his colleagues to see what they thought:

This guy wasn't so happy about it:

Here, TPM put together all the clips of DeLay from last night in one. Lots more shaking and you can hear what the judges had to say, like, "You're crazier than Sarah Palin" and stuff like that.

Beck interview

Short and long of it: Glenn Beck explained his "Obama is a racist" comment in his interview with Katie Couric on her new Web cast that launched Tuesday night called @Katie Couric.

He's not sorry, but he's "sorry the way it was phrased" in this sound-bite culture.

If you'd like, you can watch the whole interview below. 'Tis about 45 minutes.

Amongst other things, Beck talks about who he thinks his audience is, his problem with people in the White House, how he doesn't have a problem with Dems, how the extreme peeps on the fringes are ruining everything and some of the things he agrees with Obama on. He also adds that he isn't a journalist, but a comment guy.

There is also more to the Obama is racist explanation (around 20 min.) and some very personal questions toward the end.

Tips on traveling the less-traveled path.(Newcomer's Diary)

The thought of business travel usually conjures images of shuttles to the airport, crowded departure lounges, cabs to hotels, and garment bags. Restaurants featuring baked potatoes, steaks, Malibu chicken, dinner rolls. Meetings with PowerPoints and suits.

Clothing usually is composed of slacks, dress shirts, shiny shoes. Toiletries include shampoo, toothpaste and toothbrush. Maybe some aspirin or Tylenol for the fatigue-caused headache.

I certainly have that kind of business travel. But I also have business travel of a different kind. This kind of travel usually begins with the shuttle and the airport, but there the similarities start unraveling. This kind of business travel may involve 4x4 trucks and snakes, cold-water showers, pickpockets (and worse), as well as myriad language difficulties.

With these alternative types of trips, an equally alternative travel kit is in order. I have learned, oftentimes the hard way, a few lessons in how to travel the less beaten paths.

Clothing. In the last couple of years, I have been working on a project in the Manu region of Peru. We've been working on a water system serving a mixed native population on the edge of the Amazon where the Andes meet the jungle. One thing I discovered was the importance of pants that close at the ankles. I once heard a comic making fun of all those pants that have ankle closures. He said. "Are they keeping stuff out or keeping stuff in?" I'm here to tell you. it is to keep stuff out.

Tropical climates and especially grassy areas in the tropics are alive with little bugs that have their way with your ankles if you let them. I know a Brazilian anthropologist who duct-tapes his pants closed around his socks. Light colors are important too--tsetse flies are drawn to dark colors. In Peru, you may travel from 200 feet in the jungle to over 11,000 feet in the Andes in a few hours. Lightweight layers of clothing are essential, as well as many, many pockets for everything from cameras to GPS to notebooks or cookies.

And don't forget that hat! I did once and it almost cost me sunstroke listening to a long drawn-out speech on a plaza in Nicaragua during the noon heat (although I admit that drinking Fleur de Cana at a New Year's party the night before and only getting a couple of hours sleep in 48 had something to do with my general condition that day). Fortunately, a thoughtful person loaned me a painter's paper hat.

Speaking of shorts, they are oftentimes not appropriate outside of tourist areas in Central and South America, nor are sleeveless blouses for women. And don't show the bottoms of your feet to anyone in Thailand, they will be gravely insulted. Details, details.

The toiletry kit needs a bit of enlarging also. Besides shampoo and razors, it's a good idea to take Neosporin and anti-fungal cream. A small wound in the tropics can turn into an ulcer quickly. DEET insecticide is essential. I put it on my clothes, my skin, everywhere but around my eyes. Some people like to throw in ORT (Oral Rehydration Therapy). If you get ill, it is important to keep your electrolytes balanced. ORT contains salts and glucose. If you get cholera, it is important to drink as much water as you can to keep from debilitating or fatal dehydration.

A washcloth and a towel should also be in there somewhere, as they may not be available at local hotels. And there are more than 50 known uses of the Southeast Asian sarong, those batiked wraparounds so popular in Thailand.

I tend to leave the laptop at home on these trips. The tropics are not friendly to laptops, nor are bumpy back roads. I have one friend that bought a Panasonic armored model after her regular business laptop broke two months into the Peruvian experience. I do take my GSM network Treo 600, though. If you order the phone direct from the factory "unblocked" it will work just about anywhere in the world. When I was in Sumatra in March, I could get my e-mails by pushing one button. With a PDA like that, I can do without the laptop, especially since all major cities and airports these days have Internet cafes.

Food is always a big issue with adventure/business travel. I tend to eat and relish everything, everywhere I go. I like to partake of the local food for the pleasure of new tastes, as a way to show respect to those I am dealing with, and as a way to understand the local culture. There are some rules here though. To avoid the scourges of typhoid, I never eat raw foods that I can't peel myself. Avoid salads, anything uncooked. I drink water that I know is safe, either bottled, chlorinated, or water from one of our slow sand filters.

A whole other topic is personal security, but at least remember the three A's--Awareness, Assessment, and Action. Ruminate on those words for now and I'll share some of those experiences another time.

And finally, I try to check the news before I go. I always feel really dumb when I arrive in a country to find a revolution going on that I wasn't aware of. Substitute "revolution" for "hurricane" or "national strike"--and you get the picture.

No matter where you travel, however, as the Boy Scouts always say, it pays to be prepared.
